In the present controversy on whether disconnecting users from their internet access for the offence of illegal downloading is violation of human rights or not, France is finding herself in a dilemma over its proposed way of dealing with illegal downloads.

The French National Assembly had recently come up with a draft law proposing disconnection as punishment for deterring persistent offenders. Though the decision was quite contrary to the popular perception on the matter, a simple majority of 285 against 225 helped in passing the draft. However, there were constitutional issues with the initial draft and hence, the legislature had to come up with a new draft, which was finally passed.

The present law provides for a ‘three step’ system that would require a new state agency to warn illegal file sharers with an email first, and if the mail is ignored, proceed to the next step, wherein a letter will be sent. This will be the final warning before discontinuing broadband services permanently, if the offender is found to continue with his illegal internet piracy acts for a third time.

The three-pronged test is akin to the one introduced by UK Business Secretary, Lord Mandelson, for curbing piracy menace in the UK. Because the internet has become a basic need for most of us, and with the advent of networks offering broadband deals, it can be accessed whenever and wherever a person wants, this makes the thought of people not being allowed access extraordinary. However, there is a fear that if the European Parliament steps in and decides that such disconnection is a human rights violation, both the UK and France will have to stall their plans.

Communications watchdog Ofcom has confirmed that the number of complaints received for telephone and broadband snags has fallen in the last year. According to Ofcom, this fall in figures may have been caused due to the influence of the global economic crisis like a sluggish market for housing. VoIP (Voice over internet protocol) represents the next generation of Phone services. The VoIP technology uses a high speed internet connection (such as DSL or cable) rather than a traditional phone line, for the transmission of voice signals. The use of this technology costs significantly less than the use of traditional phone lines. Think of it as having to send a document to someone by fax versus sending the same document by e-mail. Which option is cheaper? The cost of faxing a document depends on where you’re faxing it to and how many pages you’re faxing (and therefore how long you’ll use the phone line). E-mailing the document costs the same thing regardless of where you’re e-mailing it to and how many pages you’re e-mailing. The same applies to VOIP.

There are several providers currently offering VOIP phone services such as Vonage, lingo and packet8 among others. The calling plans range in price from $10 to $30 a month. Most have unlimited long distance calling and free features such as call waiting, caller ID, voicemail, etc without additional costs. The cost advantage of VOIP is such that traditional phone providers such as Verizon and AT&T have already begun to offer VOIP phone services which also cost significant less than their regular plans. Therefore, the VolP technology is set to bring lower prices and improved services to the consumer as a result of more competition.

There are generally three kinds of VOIP calling:

1)_ATA (Analog telephone adaptors): your phone is plugged into special router which is in turn connected to the internet. This router converts analog signals from your phone into digital packets of data which can then be sent through a high speed internet connection. If the person you’re calling also has VOIP, these packets of data travel exclusively through the internet all the way to the other side of the line. If you’re calling a regular phone, then a part of the journey must be made through regular phone lines. That’s why there is a cost involved. It is this kind of VOIP that providers such as Vonage, lingo, packet8 and others rely in order to provide their services. Because your “voice” travels mostly through the internet the cost of the calls is much lower, and therefore the calling plans are much cheaper.

2)_IP(internet protocol) phones: these phones look exactly like standard phones, but instead of connecting to a normal phone cable, they connect to an Ethernet cable which in turn plugs directly into your router or broadband modem. This way the conversion of your voice into digital packets of data happens inside the phone, rather than in a VOIP router.

3)_ Computer to computer: this is currently the most popular kind of VOIP calling. Computer programs such as Skype, allow you to talk to anyone anywhere in the world for free! All that is needed is a microphone and a speaker on each of the computers. Since this technology uses exclusively the internet connection to get from one end of the line to the other, there is no cost for the user. It’s like exchanging e-mails messages, except that packets of data containing voice rather than words are traveling through the internet. For a small fee, these programs also allow you to make calls to regular phones

One good feature of VOIP is that you’re not tied to a particular area code. Suppose you live in New York but most of your friends and family live in Los Angeles. You could choose to have an area code from Los Angeles added to your phone, so that all the calls that originate in LA count as local calls rather than long distance calls. That way, your friends and family pay only for a local call even though they’re calling you from across the country.

The Global Positions System (GPS) satellites are free for anyone to use. However, to use it, a GPS receiver is required which is not free. In recent years these GPS receivers have become very small and embedded in mobile phones. This has given rise to many location based services. Though there are many LBS applications that are very useful, there are a few applications that are misused.

One of the location-based services as mentioned at http://www.m-indya.com is Child Tracking. In a study carried out by New Media Technologies students (2005) in Australia, they have detailed how this service can be misused. They state that,

“In 1998 the US implemented the Children’s Online Privacy Protection Act 1998 which limits the ways Web site operators and others may collect and disseminate information pertaining to customers under the age of 13. So far, Australia has not followed suit and does not seem to have a law, which directly protects children from technology such as the Internet. With the introduction of global positioning systems for tracking purposes, the issue of child protection needs to be addressed before this technology gets into the wrong hands and used for malicious purposes.”

Some of the other consequences that may occur due to these services are the problem of parent-child relationship and also marital relationship. In their study they point out “parents should negotiate with their teenagers an agreeable form of knowing where they are whether it be GPS on their phone or just a phone call to let them know where they are. This will ensure that the relationship will not be damaged through a form of mistrust.”

And even between spouses each needs a bit of their own space and privacy, which will be jeopardised by the use of this service and may cause problems in marital relationships.

In a ZDNet news by Lisa Bowman (1999) speaks of some scary scenarios where this technology can be misused such as, “Insurance companies could refuse to insure you, or charge you higher rates, unless you install a tracking system on your car. They could then tell if you drive over 55 or spend time in shady neighbourhoods where your car has a greater chance of being stolen.” Or “FBI and local police officials could have access to your whereabouts by simply logging onto a database attached to a cell phone, tollbooth or GPS tracker”.

In yet another case a rental car company was sued by the customer for tracking him down using GPS. “In a case that could help set the bar for the amount of privacy drivers of rental cars can expect, a Connecticut man is suing a local rental company, Acme Rent-a-Car, after it used GPS (Global Positioning System) technology to track him and then fined him $450 for speeding three times.” (Robert Lemos, 2001).

A Wireless week (2003) article lists how even location based games can be misused. “In Sweden, thousands of wireless game subscribers stalk each other using cell phones and location technology. In Japan, you can use a GPS-enabled cell phone to arrange a date, an application sometimes used by teenage prostitutes. In many countries around the world, a GPS-based game called “geocaching” is growing in popularity.” Ever since Princess Diana’s death the perils of stalking has come to the forefront in the media. My wife and I have been trying Uverse for roughly 2 months. Whilst ATT brags about the number of high def channels it offers, I am like the greater number of television watchers who not only do not have a hd capable tv, but also still use old school analog formats. We only hooked up U-verse to the set in our living room. But the companies bundles will let you hook up to 3 and more if you are prepared to pay more. The TIVO-like device hooks up to one TV, and the others can pull recorded shows off it. I ordered the U400 packaged option, which comes with about 270 non-HD channels and begins at $97 a month. ATT has bundled deals that mix U-verse and Net access, but do not start getting excited at the idea of 100-Mbps Web surfing. The internet access bundled with Uverse is pretty much the same as ATT’s base package, though uploads are improved.

ATT installations take a number of hours, depending on if your house should be changed to accommodate U-verse. In our case, technicians had to modify the wiring in the back of some of the telephone jacks. Because I have been using regular wiring, I’d not yet attempted a Video on Demand service, which U-verse includes. This allows you to select from both films and shows from a variety of your stations, including Starz, and play them on your Television like a DVD player.

Reports in the press suggest that a sale or merger is on cards for T-Mobile in the UK, as its parent company Deutsch Telekom is looking forward to getting rid of the underperforming unit.

Among the smallest mobile phone and mobile broadband providers in the country, T-Mobile UK has been recording poor performance in a highly competitive market with low margins, which had recently led to a profit warning from its parent. The shareholders of Deutsche Telekom are clearly unhappy with the drag that T-Mobile is causing on its profits, and are thus pressurising the management to look for a strategic option that frees the company from its UK operations (click here to compare mobile broadband).

It has also been revealed that Deutsche Telekom wanted to withdraw from the UK telecom market over six months ago, but the final decision was kept pending until things became more settled or some other door was opened. Now, it seems, the parent company feels that it is time to make that critical decision.

Several mobile operators could be in the race to take on T-Mobile’s business in the UK, but 3 and Orange are said to be the frontrunners.

Interestingly Deutsche Telekom CEO, René Obermann, had announced just last month that he would be bringing in new management to revive the UK operations. However, if a deal does materialize, these plans are obviously likely to be frozen. The company has not offered any comment so far on the speculation, which is usually the case in such matters.
